Notice of Policy Updates

 

 

 

 

Complete Lab & Drug Test, LLC. (Consortium/TPA) Responsibilities

 

  • Complete Lab & Drug Test provides Consortium Services for Federal Motor Carrier (FMCSA) only to The Employer/Company
  • Complete Lab & Drug Test provides Certificate documenting the Employer/Company’s participation in a DOT 49 CFR Part 40 compliant program
  • Complete Lab & Drug Test provides computerized random selection process fully compliant with DOT regulations
  • Complete Lab & Drug Test does not provides DOT Federal paper Custody & Control forms at all
  • Complete Lab & Drug Test provides username, password and access  to order online DOT Drug & Alcohol test with access to collection sites nationwide
  • Complete Lab & Drug Test ensures that all Drug Testing is completed by a DOT compliant (SAMHSA) laboratory
  • Complete Lab & Drug Test provides a DOT certified Medical Review Officer (MRO) review for every drug test result
  • Complete Lab & Drug Test provides 24/7 support
  • Complete Lab & Drug Test provides all test results in a secured and confidential fashion by access to an online portal with  username/ password provided to the Employer/Company
  • In the event of a positive test result, Complete Lab & Drug Test provides access to a network of DOT compliant substance abuse professionals (SAP’s) available in the Employer/Company’s area
  • As directed by SAP, Complete Lab & Drug Test provides Follow-Up test notifications to the Employer/Company’s DER (Supervisor)
  • Complete Lab & Drug Test provides verification of Compliance, Driver Names, and any other available Information to DOT Auditors as requested
  • Complete Lab & Drug Test does not maintain paper copies of any Drug and/or Alcohol Test Results for The Employer/Company

     

The Employer/Company (The Employer/Company and/or Owner Operator)

Responsibilities

 

  •  
  • The Employer/Company agrees to use Quest Diagnostics electronic forms that Complete Lab & Drug Test provides via the client portal for All Drug Testing
  • The Employer/Company agrees to keep only a valid company credit card and/or ACH on file for future Testing Charges
  • The Employer/Company agrees to not use their potential employee’s person credit card/Debit card when ordering tests 
  • The Employer/Company agrees to take full responsibility to refund/reimburse if potential employee’s personal credit card/Debit card
  • The Employer/Company agrees to Complete All Random Selections within the Selection Period to remain Active in the Random Pool
  • The Employer/Company is Responsible for all After Hours and On-Site Collection Fees
  • DOT requires The Employer/Company to ensure all Drivers have a DOT Compliant Negative Pre-Employment Drug Test Result in The Employer/Company’s Name prior to allowing Driver on the Road
  • DOT Requires Drivers to take a new Pre-Employment Drug Test if the Driver has not been in a Random Testing Program within the previous 30 Days
  • The Employer/Company must complete all Random Testing within Selection Period
  • DOT Requires The Employer/Company to Maintain Legible Paper Copies of all Drug & Alcohol Test Results to be made available for Review and/or Audit including Pre-employment, Random, Post-Accident, Reasonable Suspicion, Follow-Up, and Return-to-Duty Test Results
  • DOT Requires The Employer/Company to complete verification of prior Drug and Alcohol Violations process for each new Driver
  • DOT Requires The Employer/Company to Provide ongoing and timely information of all changes to the Driver(s) to Complete Lab & Drug Test
  • DOT Requires The Employer/Company to distribute Random Selection Notifications to Drivers within the Selection Period
  • DOT Requires The Employer/Company to ensure Selected Drivers report for Random Testing Immediately upon being Notified
  • DOT Requires The Employer/Company to determine if a Post-Accident Drug and Alcohol Testing is Required following an Accident
  • DOT Requires The Employer/Company to determine whether or not to conduct a Reasonable Suspicion Test
  • Complete Lab & Drug Test Requires The Employer/Company to provide Complete Lab & Drug Test with Secure and Confidential Email to receive Notifications of available Test Results, Request for updated of driver active list, Random selection Notifications, and Invoices
  • DOT Requires The Employer/Company to Provide All Drivers who Test Positive for Drugs and/or Alcohol with a SAP Referral
  • DOT Requires The Employer/Company ensure Drivers do not Resume Driving prior to SAP Approval and Negative Return-to-Duty Drug Test Results
  • DOT Requires The Employer/Company to provide Reasonable Suspicion Training for All Supervisors
  • DOT Requires The Employer/Company to Serve as the Primary Custodian of The Employer/Company Records
  • Complete Lab & Drug Test Requires The Employer/Company to provide completed DOT Breath Alcohol Test Results by Fax and/or Email to Complete Lab & Drug Test within 24 hours
  • The Employer/Company is responsible for the outcome of any DOT Audit and/or Inspection
  • The Department of Transportation Regulations Governing Drug and Alcohol Testing Programs (49 CFR Part 40) makes it very clear that the Employer/Company (also referred to as ‘The Employer/Company’) is responsible for all aspects of compliance with the regulations.  That applies even if Complete Lab & Drug Test, LLC. has been designated as a service agent.  It is critical that The Employer/Company understand this concept.  The responsibilities for each party are outlined below.

     

Payment/Invoice Terms & Conditions

 

Payment is render at the time of ordering test.  Invoices are sent to the email address that is provided upon enrollment and email can be edited at “My Account” – “Company Profile”. All transactions will be posted to transactions page at “My Account” – “Transactions”.  The Employer/Company is required to have a valid company credit card on file which is automatically charged for all testing charges.  The Employer/Company will be charge drug and alcohol testing fees upon ordering the Qpassport ID authority code. Complete Lab & Drug Test will automatically be process payment  from the Employer/Company’s credit card as soon as the computerized system generates the Random Selection tests and orders the Qpassport ID authority code.  Prices are subject to change. 

 

The Employer/Company will provide to Complete Lab & Drug Test a valid credit card number payment information as allowed by Complete Lab & Drug Test (collectively, “Payment Device”). Along with the Payment Device you will provide all information necessary to use the Payment Device such as the expiration date for the credit card and other information requested by Complete Lab & Drug Test, and you hereby authorize Complete Lab & Drug Test to charge to the Payment Device all Fees applicable to your purchase of Upon cancellation, expiration, or any change to the Payment Device, you will immediately provide a new Payment Device and other information requested by Complete Lab & Drug Test. For convenience, Complete Lab & Drug Test may provide you with an invoice, at Complete Lab & Drug Test’s discretion. You are required to pay all Fees regardless of whether you receive an invoice. If you have not paid all sums due Complete Lab & Drug Test in accordance with the terms of this Agreement, all services will be canceled and access to the client portal will be limited. Complete Lab & Drug Test will not charge interest fee or late fee,  simply all services will cease to be provided to the Employer/Company.

 

If the Employer/Company has an invoice is not paid within 30 days and/or The Employer/Company’s Email & Phone is disconnected, The Employer/Company’s account will be Terminated.  The Employer/Company that Dispute an payment will be immediately be terminated.

 

The Employer/Company authorizes Complete Lab & Drug Test to charge The Employer/Company’s credit card/ACH on file for all outstanding subscription invoice when The Employer/Company is past due on any Invoice.

 

 

Dishonored Check Charges

 

The Employer/Company understands it authorized to charge payment information it provides and it will remain in effect until The Employer/Company cancel it in writing, and The Employer/Company agree to notify Complete Lab & Drug Test, LLC in writing of any changes in The Employer/Company’s account information or termination of this authorization at least 15 days prior to the next billing date. If any payment dates fall on a weekend or holiday, The Employer/Company understand that the payment may be executed on the next business day. When The Employer/Company provides credit/debit card, it understands for this service it would be charge 3%processing fee per transaction. The Employer/Company understand that because this is an electronic transaction, these funds may be withdrawn/ or cancel from its account as soon as the transaction is requested. In the case of an ACH Transaction being rejected for Non-Sufficient Funds (NSF) The Employer/Company understands that Complete Lab & Drug Test, LLC may at its discretion attempt to process the charge again, and agree to an additional $25 charge for each attempt returned NSF which will be initiated as a separate transaction from the authorized amount. The Employer/Company acknowledges that the origination of ACH transactions to their account must comply with the provisions of U.S. law. The Employer/Company agrees not to dispute this pre-billing with their bank so long as the transactions correspond to the terms indicated in this authorization form.

 

Drug Testing Fees

 

In-Network Collection Sites

  •  
  • Complete Lab & Drug Test charges $55.00 for Laboratory Testing & MRO Services which includes the Collection Site fee
  • The Employer/Company agrees to only use Quest Diagnostics forms via Complete Lab & Drug Test’s client portal online network for All Drug & Alcohol Testing

     

Out-of-Network Collection Sites

  •  
  • Complete Lab & Drug Test charges $55.00 for Laboratory Testing & MRO Services Plus you are responsible for the Collection Site fee.  (Example: Concentra is an Out-of-Network Collection Site)
  • Complete Lab & Drug Test does not accept any Out-of-Network test result and The Employer/Company agrees to retest ordering via the client portal and actually using Qpassport ID authority code.

 

Observed Collections

 

Complete Lab & Drug Test charges $65 for Observed Collections at Preferred Sites and Quest Diagnostics PSC Sites. 

 

Complete Lab & Drug Test does not provide third-party collection sites’ data information on the in network client portal system.

 

Contesting Positive Drug Test Results

 

Drivers have the Right under DOT to Contest Positive Drug Test Results and it is the Responsibility of The Employer/Company (The Employer/Company and/or Owner Operator) to pay to send Sample B to another Laboratory for Testing.  Complete Lab & Drug Test Automatically charges $200 to The Employer/Company’s credit card/ACH.

 

Breath & Saliva Alcohol Testing Fees

 

Complete Lab & Drug Test  charge $50 for Breath & Saliva Alcohol Tests.  The Employer/Company is Responsible to Fax and/or Email Alcohol Results to Complete Lab & Drug Test.  Breath Alcohol Testing fees are automatically charged to The Employer/Company’s credit card/ACH on file when Complete Lab & Drug Test. 


Membership Renewals

 

The Employer/Company’s Membership will automatically renew 15 days before expiration.  Membership Enrollment & Renewal Fees are Non-Refundable.  Upon Renewing your Membership the Employer/Company agrees to keep a valid credit card/ACH on file for future Testing Charges.

 

Adding Drivers to the Random Pool

 

Once the Medical Review Officer (MRO) Reports Negative DOT Pre-Employment Results The Employer/Company’s Drivers will Automatically be Added to the Random Pool.  The Reason for Testing must be Pre-Employment for the Driver to be Added to the Random Pool.  The Employer/Company Must use Complete Lab & Drug Test’s client portal to order for All Drug Testing.

 

Deactivating Drivers from the Random Pool

 

The Employer/Company is Responsible to Login to their client portal account and Deactivate Driver(s) Immediately upon Termination or being vacation.  Drivers may be Reactivated within 30 Days before a New Pre-Employment Drug Test is Required by DOT.

 

Complete Lab & Drug Test will notify The Employer/Company via email and text message to verify The Active Driver List 30 days prior to the system generates the random selections.

 

Random Selection Notifications

 

Complete Lab & Drug Test Notifies The Employer/Company (The Employer/Company and/or Owner Operator) DER (Designated Employee Representative) for Quarterly Random Selections by Email, text message and in the client portal account.

 

Cancellation of Agreement

 

Either party may cancel this agreement at any time upon 30 days written notice. The Employer/Company Memberships are Non-Transferable and Non-Refundable. 

 

The Employer/Company Agrees to Release Complete Lab & Drug Test, LLC.

 

The Employer/Company hereby release Complete Lab & Drug Test, hold harmless from, and agree not to sue Complete Lab & Drug Test, and its officers, managers, members, employees, agents, vendors or independent contractors from any and all rights, claims, costs, expenses, including legal fees, demands, actions, liabilities and causes of action, whether accrued or unaccrued, fixed or contingent, legal or equitable, and which in any manner relate to or arise out of Complete Lab & Drug Test’s collection, storage, use or disclosure of the Collected Data in accordance with this Agreement and of any of the representations, warranties, or agreements made under this service agreement.

 

LIABILITY DISCLAIMER

 

THE WEB CONTENT MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. COMPLETE LAB & DRUG TEST OR VENDORS MAY MAKE IMPROVEMENTS OR CHANGES IN THE WEB CONTENT AT ANY TIME. ALL WEB CONTENT IS PROVIDED AS IS WITHOUT WARRANTY OR CONDITION OF ANY KIND. THE EMPLOYER/COMPANY AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE WEB CONTENT, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE EMPLOYER/COMPANY OR VENDORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE WEB CONTENT, WITH THE DELAY OR INABILITY TO USE THE WEB CONTENT, THE PROVISION OF OR FAILURE TO PROVIDE WEB CONTENT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF THE EMPLOYER/COMPANY OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY WEB CONTENT, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE EMPLOYER/COMPANY WEBSITE.

 

Termination from Complete Lab & Drug Test Consortium

 

The Employer/Company’s failure to pay Complete Lab & Drug Test for overdue invoices for Drug & Alcohol Testing will be terminated from the Consortium and forfeit any remaining time of Membership. The Employer/Company’ failure to keep a valid credit card/ACH on account for Testing Charges and/or Renewals may be terminated from the Consortium.  The Employer/Company’s failure to comply with the Regulations as set forth by 49 CFR Part 40, such as not completing all Random Testing within Selection Period will result in Termination from Complete Lab & Drug Test, LLC DOT Drug & Alcohol Consortium and forfeit any remaining time of Membership.  The Employer/Company forfeit any remaining time of Membership and will not be Reactivated and no Refund will be issued.  Membership Fees are Non-Refundable.

 

These changes are currently effective for all clients (The Employer/Company and/or Owner Operator). We encourage you to review the Policy Updates and familiarize yourself with the changes that are being made. If you do not agree to any of these changes, you may close your account.
